These Terms govern the use of SpotLinkr, a platform to create and publish websites, run by ALTF4 Desenvolvimento e Consultoria Ltda – EPP, CNPJ 42.376.604/0001-87, headquartered at R. Dr. Pedro Lúcio, 70, Jd. Universitário, Marília/SP, CEP 17526-240, Brazil (“SpotLinkr”, “we”). By creating an account you state that you have read and accept these Terms and the Privacy Policy.
1. The service
SpotLinkr lets you create sites (portfolio, sales page, blog, events, gallery and more), publish them at a yourname.spotlinkr.com address or on a domain of your own, edit them in the dashboard and follow their visits. Some features use artificial intelligence to suggest texts, colours and translations; always review the result before publishing.
The service may change over time: features may be added, changed or removed. Changes that affect what you use in a relevant way will be announced reasonably in advance.
2. Your account
- You must be 18 or older and give a valid e-mail address that is yours.
- You are responsible for keeping your password secret and for everything done with your account.
- An account may have several sites. Whoever creates a site is its owner.
- Tell us at dev.altf4@gmail.com if you suspect misuse of your account.
3. Your content
The content you publish (texts, images, brands, data) remains yours. You grant us a non-exclusive, free licence, limited to what is needed to host, display, fit to the layout, translate and deliver that content to visitors while the site exists.
You guarantee that you hold the rights to what you publish and that the content is lawful. The photos suggested automatically come from free image libraries (public domain or CC0); check that they suit your use.
4. Forbidden uses
You may not use SpotLinkr to:
- publish content that is illegal, defamatory, discriminatory, violent, sexually exploitative or that infringes others' rights (copyright and trademarks included);
- run scams or phishing, or pose as another person or company;
- spread malware, send spam, or attack, overload or try to get around the platform's security;
- collect visitors' personal data without a legal basis or without telling them;
- sell products or services forbidden by law.
We may remove content or suspend a site or an account that breaks these Terms or the law, telling you whenever possible, and we comply with court orders to remove content.
5. Addresses and own domains
- The .spotlinkr.com subdomain is yours to use while the site exists and can't be transferred.
- An own domain stays registered in your name, at your registrar. By connecting it, you authorise its DNS to be managed from our Cloudflare account while it is connected; it is up to you to review the imported records (e-mail ones above all) and to keep the domain renewed.
6. Your site's visitors' data
As to the personal data of your site's visitors (contact messages, visit statistics, purchases), you are the controller and SpotLinkr is the processor, under the LGPD. This means that:
- we process that data only to provide the service, under these Terms, and don't use it for our own purposes;
- we use the providers listed in the Privacy Policy, who are authorised as sub-processors;
- we take security measures and tell you about incidents affecting that data;
- we help you answer data subjects' requests and delete the data when the site is deleted;
- you are responsible for informing your visitors about the processing (for example, in a privacy policy of your own) and for having a legal basis for it, including consent for Google Analytics, when you set it up.
7. Plans and payment
Today sites can be created and published for free. If we start charging for plans or features, the prices and conditions will be stated first, and nothing will be charged unless you expressly sign up for it. The sales your site makes through Mercado Pago also follow Mercado Pago's terms, and you are responsible, towards the buyers, for what you sell.
8. Termination
- You can delete your account whenever you want, under My account. The sites you alone own go offline right away and are deleted for good after 90 days, during which you can change your mind (details in the Privacy Policy).
- We may close an account that seriously breaks these Terms or the law, or end the service as a whole, in that case with at least 30 days' notice so you can save your content.
9. Warranties and liability
We work to keep SpotLinkr up and secure, but the service is provided “as is” and may have interruptions, for maintenance or because of failures of ours or of our providers. Keep copies of the content that matters to you.
To the fullest extent the law allows, we are not liable for lost profits or indirect damages, nor for the content users publish. Nothing in these Terms limits the rights Brazil's Consumer Protection Code grants consumers.
10. Changes to these Terms
When these Terms change in a relevant way, we'll let you know in the dashboard and ask you to accept them again before you keep using the account. If you don't agree, you can delete the account. The date of the last update is at the top of this page.
11. Law and jurisdiction
These Terms follow the laws of Brazil. The courts of Marília/SP, Brazil, have jurisdiction over any matter about them, without prejudice to a consumer's right to sue in the courts of their own domicile.
